NEW PC SOFTWARE ENABLES EMPLOYERS TO DOCUMENT COMPLIANCE WITH ADA
LAS VEGAS, June 29 /PRNewswire/ -- Verimation, Inc., a provider of computer-based employment processing services and software, today announced a new software program to assist employers in complying with Title I of the Americans With Disabilities Act (ADA).
The company also announced that follow-on software for analysis of ADA's required "Reasonable Accommodations" of disabled employees will be available in the near future.
The impact of the employment provisions of the ADA, which go into effect July 26, will be far greater than is generally anticipated, a Verimation official warned. "The effective date is only the beginning of the compliance phase," said Douglas Easters, president of the Atlanta-based firm. "The provisions of the ADA are very broad, providing ample opportunity for expansive judicial interpretation. As case law arises from legal actions, compliance will have to be fine- tuned, demanding that employers be both vigilant and responsive. Compliance is going to be complicated, but does not have to be costly."
To be in compliance, a company must have determined the essential evaluation criteria for each job, and that criteria must withstand regulatory and judicial scrutiny. Otherwise, a company will not be able to substantiate its employment decisions.
Verimation's new software, VmS JOBDES, provides employers with a job description master file which can be modified as ADA case law evolves. JOBDES allows managers and supervisors with limited working knowledge of ADA to quickly become productive contributors to the job description process providing the critical evidence for validating "essential" criteria.
Verimation introduced the new product at the national conference and exposition of the Society for Human Resource Management in Las Vegas. Almost 4,000 were in attendance for the four-day conference.
The JOBDES process develops the data bases required to support an employer's candidate evaluation procedures as mandated under the ADA, while providing a consistent format for validating selection criteria and making "job-related and business necessity decisions."
"This software is self-contained and will educate a user on the Title I guidelines of the ADA as they define essential job functions, identify direct threats, establish job qualification standards and standard testing facilities," Easters said at a news conference. "The result is documentation of an employer's job functions prepared on a consistent company-wide basis within the spirit of the law."
