NEW APPEAL FILED ON 2,300 HOMES SCOPE SAYS FURTHER REVIEW NEEDED.

Byline: Daily News

VALENCIA - An environmental group has appealed a January court ruling that allowed The Newhall Land and Farming Company The Newhall Land and Farming Company is a land management company based in Valencia, California, United States. The company is responsible for the master community planning of Valencia, as well as the management of farm land elsewhere in the state.  to go ahead with its 2,300-home West Creek

Situated in the Santa Clara valley and nearby canyons, Santa Clarita includes the former towns of Canyon Country,  Organization for Planning the Environment filed its appeal Wednesday, hoping to overturn a judge's determination that Newhall Land's revised environmental documents for the project were adequate.

SCOPE President Lynne Plambeck said construction is planned in a floodplain floodplain, level land along the course of a river formed by the deposition of sediment during periodic floods. Floodplains contain such features as levees, backswamps, delta plains, and oxbow lakes.  next to major tributaries. ``We don't think it's safe for the future residents, and it impacts our ability to have water recharge out of the streams and rivers,'' she said Monday.

The creek is a tributary of the Santa Clara River Santa Clara River may refer to:
  • Santa Clara River (California), a river in Southern California, United States.
  • Santa Clara River (Utah), a river in Utah, United States
  • Carmen River, a river in Mexico that is sometimes called the Santa Clara River
, a normally dry swath that runs from Acton to Oxnard and feeds wells for Ventura County agriculture.

``If you lose all your recharge from paving over everything, you'll dry out the river,'' Plambeck said. ``We should all be taking care not only (of) the main river, but the tributaries.''

Plambeck's group sued Newhall Land in 1999 after the West Creek proposal was approved by the Los Angeles County Board of Supervisors The Los Angeles County Board of Supervisors is the five member governing board of Los Angeles County, California. Members of the board of supervisors are elected by district, the current members as of April 2006 are:
  • District 1: Gloria Molina, Democrat
, charging that the company's environmental impact report did not fully analyze the proposed water supply for the development, including the use of state water.

SCOPE lost initially, but won on appeal on one of four issues - documentation of the planned water supply, Newhall Land spokeswoman Marlee Lauffer said. She said the company produced additional studies in October, and a Superior Court judge ruled Jan. 12 that the analysis was appropriate.

``It's typical of Lynne Plambeck and SCOPE to try to use the legal process to delay new communities,'' Lauffer said. ``We're very confident that the court did a thorough and thoughtful review of all the issues and believe that (the judge's) ruling will hold up on appeal.''

Plambeck maintained that a final decision should be reviewed by a higher court, not just the Superior Court or trial court judge who originally had ruled in Newhall Land's favor.

``The trial court judge stated in the decision that this case is a matter of first impression,'' Plambeck said. ``He felt that there wasn't any legal precedent for the decision.''
