SCOPE lost initially, but won on appeal on one of four issues - documentation of the planned water supply, Newhall Land spokeswoman Marlee Lauffer said. She said the company produced additional studies in October, and a Superior Court judge ruled Jan. 12 that the analysis was appropriate. ``It's typical of Lynne Plambeck and SCOPE to try to use the legal process to delay new communities,'' Lauffer said. ``We're very confident that the court did a thorough and thoughtful review of all the issues and believe that (the judge's) ruling will hold up on appeal.'' Plambeck maintained that a final decision should be reviewed by a higher court, not just the Superior Court or trial court judge who originally had ruled in Newhall Land's favor. ``The trial court judge stated in the decision that this case is a matter of first impression,'' Plambeck said. ``He felt that there wasn't any legal precedent for the decision.'' |
