NEGOTIATIONS HELD IN CABLE SPORTS DISPUTE; SUBSCRIBERS DENIED DODGERS, ANGELS GAMES.

Byline: Donna Huffaker Staff Writer

At least they're talking.

That's the response from both sides in the tug-of-war blaming match between Charter Communications Charter Communications NASDAQ: CHTR is an American company providing cable television, high-speed Internet, and telephone services to more than 5.7 million customers in 29 states. It is the third-largest publicly traded cable operator in the U.S.  and Fox Sports West as executives at the highest levels have begun to sit down and negotiate.

For two weeks, 90,000 cable customers in Glendale, Burbank and La Canada Flintridge have not received programming from Fox Sports Net West and Fox Sports Net West 2. The sports broadcaster killed its signal because Charter Communications, which bought the local Marcus Cable last year, was not paying its full bill.

While the sides takes potshots at each other, the result has been a void of sports programming - all the Dodgers and Angels games - for the customers.

, spokesman for Fox Sports West. That is being negotiated, he said.

Cable and sports executives met in Chicago last week, he said, calling the negotiations ``productive, yet inconclusive INCONCLUSIVE. What does not put an end to a thing. Inconclusive presumptions are those which may be overcome by opposing proof; for example, the law presumes that he who possesses personal property is the owner of it, but evidence is allowed to contradict this presumption, and show who is .''

``It's a good sign that they're meeting. It may just be Dodgers and Angels games that the customers are missing right now, but if it's not worked out in the next couple of months, they could miss the Lakers See Lake poets , the Clippers, the Kings and the Ducks,'' Webster said.

``It could get ugly,'' he added.

The spokeswoman for St. Louis-based Charter Communications, Anita Lamont, said one of the things being discussed is whether customers will be reimbursed for the expanded basic channels they're paying for, but not receiving.

Various options are being considered, she said. No one has received refunds yet.

Fox, the contract it has with Marcus calls for a higher monthly payment than the contract it has with Charter. Charter believes it should pay the lower rate.

On June 6, the day after the programming was pulled, U.S. District Court Judge Terry Hatter ruled in Fox's favor for Charter to honor the Marcus contract.

A Charter news release from earlier this month said the dispute has nothing to do with the price of programming. It involves the cable company's plans to cut the Fox network's FX from the South and Southeast areas of the country, the release said.

Another statement from Charter says it is just trying to keep fees down for customers while Fox is raising prices to offset players' salaries, such as the $105 million contract for Dodgers pitcher Kevin Brown The name Kevin Brown can refer to several different people, including the following:
  • Kevin Brown (baseball) (b. 1965), a former Major League Baseball right-handed starting pitcher with 211 career wins

Fox owns the Dodgers.

Webster denies the cable company's claims. He suggested all cable customers complain to Charter or switch to satellite television, like DirecTV.

``We're already on DirecTV. It's great - and they pay their bill,'' he said.
