The legislation will make permanent the reduction of tenant improvements from 39 years to 15 years.

Thomas J. Bisacquino, NAIOP president, said, "The current 39-year depreciation rate for tenant improvements does not reflect the economic realities of how long the improvements will last, and we encourage Congress to make these tax provisions permanent."

In most cases, tenant improvements last about as long as the lease average, which is approximately five-to-ten years across all industrial sectors. Under current law, building owners are not allowed to properly match the expense of a commercial space to the income generated by these improvements.

"A shorter depreciation of tenant improvement will better enable building to provide tenants with the most productive workspace possible," said Bisacquino.

Conrad and Kyl have been influential in modifying the leasehold depreciation tax rules.
