N.C. SUPREME COURT RULES ON 1986 DUKE POWER RATE CASE

N.C. SUPREME COURT RULES ON 1986 DUKE POWER RATE CASE
 CHARLOTTE, N.C., April 22 /PRNewswire/ -- The North Carolina

Supreme Court today ordered the N.C. Utilities Commission (NCUC) to revisit the commission's 1986 rate order for Duke Power Co. (NYSE: DUK)
The Court's ruling came on the second appeal of the determination of the allowed return on Duke Power's common stock made by the commission on its November 1986 rate order. The appeal was argued before the N.C. Supreme Court in April 1990.
The Court ruled that the "whole record (of the hearings held before the NCUC in September 1986) fails to support the commission's approved rate of return on common equity," and handed the rate order back to the NCUC for further proceedings.
The NCUC will now determine the next steps in response to the Court's ruling.
