Muslim Community Association to Appear Before Santa Clara Superior Court to Refute LSI Logic's Motion.

LSI Logic is Seeking Eviction Order Against Muslim School

Today, the Muslim Community Association (MCA) will appear before Santa Clara Superior Court Judge John Flaherty to hear its case against LSI Logic Corporation. LSI is seeking an order to enforce a previous court writ vacating MCA's use permit. "LSI Logic has again rehashed the same arguments which were denied in its past three applications," said MCA's attorney Javed Ellahie. "LSI's actions are analogous to a vexatious litigant who ignores a court's reasoned denials of its requests, and continues to file, refile and refile the same requests without a legal or factual leg to stand on," added Ellahie. Mahmud Musbah, MCA's Board Chairman and a semiconductor engineering manager, said, "LSI Logic's legal stunts against MCA are nothing more than an example of corporate muscle flexed against a small community." LSI's motion against the MCA conditional use permit was dismissed previously by Santa Clara Superior Court John Flaherty.

Background: Since it was granted a use permit by the city of Santa Clara four years ago, the Muslim Community Association has been operating a house of worship and school near LSI Logic, a semiconductor corporation. LSI filed a lawsuit against the city for allegedly violating its own zoning laws. The Superior Court upheld the city's decision but the Appellate Court revoked MCA's use permit pending the completion of an Environmental Impact Report (EIR). The MCA complied with the court's decision and fully cooperated with the city in the EIR process. The Planning Commission is expected to hold its final hearing on the EIR on December 17. On July 18 and 28, LSI Logic appeared before the Superior Court seeking an ex parte order to close the school but was turned down. It appeared again on September 11 but Judge Flaherty deferred the hearing to November 25.

Commenting on LSI's argument that the Muslim School children are not safe near LSI's facility, Mahmud Musbah responded by saying, "While raising concerns over our children's safety, LSI does not seem to be concerned about the safety of the young children and teens from the drum and bugle corps who practice almost daily in the parking lot of a building adjacent to its facility. Senior citizens, some in wheelchairs, play bingo three nights a week in the same building. Across the street, Gold's Gym has a day care facility for small children."

Silicon Valley is peppered with day care centers, schools and churches in light industrial zones. A case in point is Rainbow Montessori School and Day Care in Sunnyvale, a neighboring city, located across a mere fence from AMD, a semiconductor facility five times the size of LSI Logic. King's Academy and Jubilee Academy and day care are both located near Phillips' semiconductor Fab.

The Former mayor of Santa Clara Eddie Souza said, "LSI Logic's legal actions appear to be based solely on intolerance and stand to burden our city and residents with unnecessary expenses and troublesome lawsuits." Herb Schmidt, Lutheran pastor at Stanford University, said, "If this (Islamic center) was a synagogue or a Roman Catholic parochial school, this would not be happening." -0-
