While driving to work on his motorcycle, Dr. MacQueen was killed when he was hit by a UPS delivery truck. The action is for wrongful death, loss of consortium, negligent hiring, negligent retention, negligence, and equitable relief.

According to the lawsuit, on the morning of July 14, 2004, Dr. MacQueen was driving his motorcycle, which was painted radiant yellow for safety, when UPS driver Purdy, without notice or warning, made a sudden and unexpected left-hand turn directly into MacQueen's path. As a result, Dr. MacQueen was literally run over by the UPS truck and killed. The lawsuit asserts UPS rewards speed over safety through a system of incentives that push its drivers to meet tightly drawn schedules and punishes those who fail to do so. It also claims UPS knew that Purdy had numerous driving infractions, including speeding tickets, before UPS hired him.

"My husband devoted many years of his life to motorcycle riding. He loved riding, learning, and teaching others about motorcycle safety. Our family will do whatever it takes, for as long as it takes, to make sure that the parties responsible for this tragedy recognize their negligence and make the necessary changes to their corporate policy to ensure that other innocent people are not needlessly and wrongfully killed," stated widow Sherry MacQueen.

MacQueen was an avid motorcycle rider for most of his adult life.
