Miller brings suit on A-B distributor.

Miller Brewing Co. and a distributor are accusing a competitor of opening cans and bottles to damage the company's beer by making it turn stale.

In a suit filed last week in a Wisconsin Circuit Court, Miller and C&H Inc. of Reedsburg say employees of Wisconsin Distributors Inc. of Madison - an Anheuser-Busch Inc., wholesaler - opened the containers in Sauk and Columbia counties.

There was no damage to products of Anheuser-Busch, Inc., the suit said.

The activities were discovered January 7, the suit continued said.

"We are appalled at this kind of illegal behavior from a competitor and we are taking this action very seriously," Miller spokesperson Elizabeth Conlisk said at the brewer's headquarters in Milwaukee.

Wisconsin Distributors declined comment, saying the suit's allegations hadn't been studied.

The suit seeks unspecified punitive damages and an injunction against tampering.
