McCabe killers 'not part of deal'.

MARY Harney last night said the killers of Garda Jerry McCabe do not fall under the terms of the Good Friday Agreement and that the government is clear about that.

The Tanaiste's comments are in conflict with the views expressed by Taoiseach Bertie Ahern in the Dail on Wednesday.

Mr Ahern said the killers of Garda McCabe would probably be released if a new peace deal is struck in the North.

But he stressed that this was not something that he wanted to do.

The Tanaiste said the Minister for Justice has indicated to Anne McCabe and the Garda Representative Association (GRA) that there will be no change in government policy without discussions with her, Ben Sullivan and the GRA.

Mary Harney said that in the context of an end to paramilitarism in all its aspects, the government may take a different view.

But she said that that situation has not yet arisen and until it does, the government is not going to negotiate on this matter.

Four men were jailed for the manslaughter of Gda McCabe in June 1995.
