Marijuana probe ongoing, police say.

For now, prosecutors are not pursuing drug charges against a Whiteaker area couple whose three adjacent homes were searched during an early morning raid last month.

The case against Tam Jericho Davage, 35, and Marcella Anne Monroe, 41, remains under investigation, Lane County Deputy District Attorney Alex Gardner Alexander Gardner (April 28, 1861 in Toronto, Ontario, Canada - June 18, 1926) is a former Canadian major league catcher.

The couple's attorney, Terri Wood of Eugene, said there is not enough evidence to prosecute her clients on allegations that they ran a marijuana growing operation on their properties.

The Oct. 17 raid failed to yield any marijuana plants and led nearby residents to complain about the tactics used by police.

 flooded the neighborhood and refused to tell neighbors what was going on.

Police spokeswoman Pam Olshanski said the evidence used to obtain the search warrant dictated the type of police response used in the raid. The SWAT team often assists when a search warrant is served, she said.

The couple and two tenants were detained for several hours while officers searched the homes at 464 Adams St., 909 W. Fifth Ave., and 923 W. Fifth Ave.

After the raid, Davage and Monroe were released on citations for felony manufacture of a controlled substance controlled substance n. a drug which has been declared by federal or state law to be illegal for sale or use, but may be dispensed under a physician's prescription. . No formal charges have been filed against them in Lane County Circuit Court.

The couple said they have never grown marijuana and that the items seized were used in Davage's jewelry-making shop, Monroe's multiple landscaping and maintenance companies, and the renovation work being done on the two West Fifth houses, damaged by trees felled in February's wind storm.

A 29-year-old man who rented one of the houses from Davage and Monroe was cited and released for possessing less than an ounce of marijuana. His girlfriend was released without any charges.

Prosecutors can wait to file charges until the statute of GLOUCESTER, STATUTE OF. An English statute, passed 6 Edw. I., A. D., 1278; so called, because it was passed at Gloucester. There were other statutes made at Gloucester, which do not bear this name. See stat. 2 Rich. II.
