Bail was lowered Monday for Artiom Badalyan, 18, who has been in custody since the Sept. 10, 1998, shooting, and he is expected to be released today while he awaits the sentencing hearing, said defense attorney Mark Geragos Mark John Geragos (born October 5 1957) is an American criminal defense attorney best known for defending pop-star Michael Jackson, actress Winona Ryder, Gary Condit, and Susan McDougal, who was involved in the Whitewater scandal. .

Badalyan, a former Daily Continuation High School A continuation high school is an alternative to a comprehensive high school primarily for students who are considered at-risk of not graduating at the normal pace. Foland-Priver, who was the case prosecutor for more than a year, said a jury likely would have found him guilty of involuntary manslaughter, not murder, because the shooting was unintentional.

The shooting also happened very quickly during a melee involving high school students, so there was some confusion in witnesses' statements, she said.

``They were friends,'' Foland-Priver said of Badalyan and Avetis ``Avo'' Demirchyan, a 15-year-old shot in the abdomen just off the Hoover campus after school last year.

whether (Badalyan) pulled the trigger or it accidentally went off. I never thought the shooting was intentional, but he committed an inherently dangerous act. He brought the gun to a school incident,'' she said.

Two groups of students got into a fistfight after school. A gun went off and Demirchyan fell to the ground. Demirchyan had been arguing with another Hoover student, not with Badalyan. Badalyan was trying to be the peacemaker, witnesses testified during the preliminary hearing.

``I've always said this is not a murder case. It's a tragedy. Artiom's heart goes out to the victim's family Victim's Family was a hardcore punk band formed in 1984 in Santa Rosa, California by bassist Larry Boothroyd and guitarist and vocalist Ralph Spight. Drummer Devon VrMeer completed the trio. ,'' defense attorney Geragos said. He called the plea agreement the appropriate way to resolve the case.

On Monday, Pasadena Superior Court Judge Victor Person lowered Badalyan's bail from $1 million to $50,000 and scheduled sentencing for Nov. 18. The maximum is 14 years in state prison. Geragos said he will ask for probation.

Foland-Priver has been transferred from Pasadena to Pomona, and Deputy District Attorney Patricia Wilkinson will represent prosecutors at the sentencing hearing. She declined comment Monday.
