MTA, INJURED WORKER REACH TENTATIVE DEAL.

MTA safety personnel were present when the wheel guards were ordered to be installed, the Aug. 20 memo further states.

The settlement has been entered into the public court record, said Charles Jarrell, the MTA's outside counsel with the Long Beach firm of Ford, Walker, Haggerty & Behar.

MTA officials declined comment on the settlement, saying it has not been made final by the board. It is on the Sept. 28 board agenda.

, who handled the case with Rex W. Jacobs of Pasadena, said the case centered on the MTA's awareness of the safety problem.

``They knew of the dangerous condition and so they had an obligation to do something,'' Jarrell said. ``The MTA argued they are the police and can't be responsible for the act (of a contractor). But in this case, they actually did know.''

Tutor-Saliba-Perini officials did not return calls for comment.

Medina had three surgeries to repair fractured bones and damaged tendons and nerves. He has limited use of his hand and now works as a security guard, Fuhrer said.
