 czar John Miller didn't have a permit for the loaded .38-caliber handgun he had in a carry-on computer bag when he was stopped last month by luggage screeners at LAX, officials said Friday.

Police officials called the failure to have a permit for the gun a ``paperwork glitch A temporary or random hardware malfunction. It is possible that a bug in a program may cause the hardware to appear as if it had a glitch in it and vice versa. At times it can be extremely difficult to determine whether a problem lies within the hardware or the software. See glitch attack. ,'' but federal authorities and the District Attorney's Office are continuing investigations of the incident, which could lead to Miller's prosecution.

The latest revelation also adds to the ``embarrassment'' that Chief William Bratton said the LAPD suffered when the gun was found Sept. 23 at LAX as Miller and his family prepared to board a flight for New York City New York City: see New York, city.

``When he applied for it there was some sort of paperwork glitch,'' she said. ``He is making amendments. I think it's a clerical error. He's attempting to get the weapon permitted.''

The Los Angeles Police Department's Professional Standards Bureau also is investigating the incident. Miller said he'd forgotten the gun was in the case.

Shortly after the incident, Bratton said he had issued Miller the gun, that Miller had a permit for it and that the weapon would be returned to him.

The chief also said Miller, who is not a sworn police officer, would not be disciplined.

Bratton could not be reached for comment Friday.

County and federal officials said they also were investigating whether criminal laws were broken.

The District Attorney's Office said carrying a gun without a permit, either in person or in a car, is a misdemeanor offense punishable by up to $1,000 fine, or a year in jail. A spokeswoman also said the issue raises a question as to whether the weapon was issued by the department in violation of state law.

Thom Mrozek, the spokesman for the U.S. Attorney's Office, said trying to take a weapon aboard an aircraft is a crime punishable by up to 10 years in prison.
