MICHAEL FOODS WINS PATENT INFRINGEMENT CASE

MICHAEL FOODS WINS PATENT INFRINGEMENT CASE
MINNEAPOLIS, March 13 /PRNewswire/ -- Michael Foods, Inc.

(NASDAQ: MIKL) today announced that a jury in the U.S. District Court for the middle district of Florida has found that Bartow Food Co., a Florida-based egg products company, willfully and deliberately infringed a patent for the ultrapasteurization of liquid eggs. The jury also found the patent to be valid.
Michael Foods is the sole license holder for this technology which was developed and patented by North Carolina State University. The company uses the technology to produce Easy Eggs(R), extended shelf-life liquid eggs, and expects to use it as part of the final processing of Simply Eggs(TM), the company's recently announced 80 percent reduced cholesterol liquid whole eggs.
The court is expected shortly to enter a final judgment including an injunction prohibiting Bartow Food Co. from further infringement, and to grant damages to Michael Foods and North Carolina State University. Post-trial motions addressing the award of attorneys fees and treble damages are being submitted. Final amounts are yet to be determined.
Michael Foods has also initiated similar patent litigation against Papetti's Hygrade Egg Products, Inc., and this action is awaiting a trial date in the U.S. District Court of New Jersey.
Michael Foods is a diversified food processor and distributor with particular interests in egg products, refrigerated grocery products, frozen and refrigerated potato products, specialty dairy products, and refrigerated soups and salads. Principal subsidiaries include M.G. Waldbaum Company, Crystal Farms Refrigerated Distribution Company, Northern Star Co., Kohler Mix Specialties, Inc. and Sunnyside Vegetable Packing, Inc.
