 MICHAEL FOODS ADDRESSES PATENT CONFUSION
MINNEAPOLIS, Aug. 24 /PRNewswire/ -- In response to misleading

reports circulating in the financial community regarding patents to which Michael Foods, Inc. (NASDAQ-NMS: MIKL) is licensee, the company today issued the following statement:
In May of this year, North Carolina State University, the patent holder of four process patents covering the production of ultrapasteurized liquid whole eggs |Easy Eggs(R)~, made application to the U.S Patent and Trademark Office to have its most recently issued process patent reissued as a product patent. Michael Foods is licensee to all four process patents and is seeking to strengthen, along with North Carolina State, this latest patent by asking the Patent Office to reissue that patent in a strong and broader form. Having product patent protection, in addition to existing process patent protection, would give the patent holder the right to control the sale and the use of the product, as well as the processing of the patented product.
There have been reports that, under the normal review process by the patent office, the reissue application could be rejected and the previously issued patents declared invalid. Patent counsel to the company and North Carolina State has advised that the previously issued patents being declared invalid is not possible. Even if the reissue application was finally rejected, which has not occurred, the originally issued patents would remain valid and in force.
The company reemphasized that the patent under review is only one of four affording the company legal rights to the ultrapasteurization technology it uses to produce Easy Eggs and its reduced cholesterol liquid whole eggs - Simply Eggs(TM).
Michael Foods is a diversified food processor and distributor with particular interests in egg products, refrigerated grocery products, frozen and refrigerated potato products, specialty dairy products and refrigerated soups and salads.
