MAN PLEADS NO CONTEST IN WATER THEFT DEFENDANT MAY TESTIFY AGAINST TWO OTHERS; PRETRIAL HEARING SET FOR FEB. 6.

One of three defendants accused of stealing water from a small Agua Dulce Agua Dulce is Spanish for "sweet water". It also refers to various locations:

 water company has pleaded no contest and could testify against the other two, a prosecutor said Wednesday.

The two other defendants, Manny Fernandez Manny Fernandez is the name of at least three people:

 and Carey Lee Moison, are accused of multiple counts of grand theft.

``It's anticipated (Tomlinson) will be a witness against Fernandez and Moison, and I think it's going to have the effect of shortening the case and moving the case to trial,'' Campbell said.

The three sat on the board of the Sierra Pelona Water Co., serving an upscale development along Sierra Highway.

The three were recalled, then arrested in March 2005 on suspicion of defrauding customers of $200,000 by creating their own company to truck in water when supplies ran short.

The complaint against the three alleged the fraud took place from July 13 to Sept. 27, 2003.

Sheriff's Department investigators said at the time the three tried to divert attention to a neighboring winery, owned by the developers of their tract, saying water was being illegally rerouted for the vineyard.

Agua Dulce Winery was never charged in the case.
