The defendant will return to North Valley Superior Court for arraignment A criminal proceeding at which the defendant is officially called before a court of competent jurisdiction, informed of the offense charged in the complaint, information, indictment, or other charging document, and asked to enter a plea of guilty, not guilty, or as otherwise permitted  Nov. 6, Schwartz said.

Brown was arrested July 30 during investigation of charges that he falsified documents for workers ordered by the court to perform community service for the clinic. That case is pending.

Prosecutors allege that Brown defrauded Olive Ruby, an 85-year-old widow, out of $258,000 over the course of several years. The defense maintains that the money was a gift from Ruby to Brown.

Deputy District Attorney Ardith Javan, who is prosecuting the case, could not be reached for comment after the preliminary hearing.

Prosecutors called several witnesses during the preliminary hearing: Detective Robert Campbell from the Santa Clarita Valley The Santa Clarita Valley is the valley of the Santa Clara River in Southern California. It stretches through Los Angeles County and Ventura County. Its main population center is the city of Santa Clarita. The valley was part of the 48,612-acre (19,672.  sheriff's station; Donna Payne, a caseworker with the Santa Clarita Valley Senior Center; Peggy Freeman, former director of the health center; the manager of the Home Savings of America branch in Valencia where Ruby had some bank accounts; and one of Ruby's neighbors.

Schwartz said that he wanted Ruby to testify on Brown's behalf, but she became ill Thursday and had to be taken to the emergency room at Sherman Oaks Community Hospital.

``I was going to call Olive Ruby (as a witness). She's been here every day, but apparently (Thursday) she grew ill,'' Schwartz said.

Ruby has a history of stroke; the prosecution maintains that her faculties are diminished and that Brown benefited financially from that situation.

``We're saying she did have the mental capacity to understand what she was doing,'' Schwartz said. ``She felt very close to Mr. Brown. He was like an adopted brother or an adopted son to her,'' the attorney said.

``She felt a great deal of affection for him,'' Schwartz added. ``Her hope was that Mr. Brown would carry on her legacy of community involvement in the Santa Clarita Valley. She had a long history of philanthropic and community involvement.''

Ruby was voted Santa Clarita Valley Woman of the Year in 1983 by a committee of past honorees.
