MAN CHARGED IN BREAKING, SLEEPING.Byline: Don Holland Daily News Staff Writer A parolee accused of forcing his way into a Simi Valley home, and then dozing off after attempting to sexually assault the lone resident, was charged Friday with five felonies. Rafael N. Morales, 26, of Los Angeles allegedly barged into a home in the 2000 block of Caldwell Avenue and claimed to have a weapon while demanding money from the resident, officials said. ``It's a weird one,'' said Simi Valley police Sgt. Andy McClusky. ``All we really know is that he began with a robbery and it progressed to a sexual assault. And following the sexual assault, he fell asleep. ``Out of fear, the victim didn't move from his position, which was next to the suspect, until family members came home.'' Residents held Morales for police. The victim, who was held prisoner for about three hours, was not seriously injured. Morales will face charges of false imprisonment false imprisonment n. depriving someone of freedom of movement by holding a person in a confined space or by physical restraint including being locked in a car, driven about without opportunity to get out, being tied to chair, or locked in a closet. It may be the follow-up to a false arrest (holding someone in the office of a department store, for example), but more often it resembles a kidnapping with no belief or claim of a legal right to hold the, sexual battery, assault with intent to commit sexual assault, burglary and strong-arm robbery in connection with the July 19 attack, said Deputy District Attorney Ed Ulloa. Before the attack, Morales had been visiting friends in the area. But he did not know the victim and Ulloa said the attack appeared to be at random. Morales, who is in jail in Los Angeles County, has a prior robbery conviction. If found guilty on the new charges, he could receive a second strike under the state's ``three strikes, you're out'' sentencing law for repeat violent felons. |
