Luxury and affordable housing need to co-exist in New York.As we all know, late last year New York City New York City: see New York, city. At the same time, the Mayor and his administration were pushing for the rehabilitation or construction of 165,000 units of affordable housing. Advocates cheered the elimination of 421-a abatements for the luxury residential sector, thinking that by reducing the amount of new luxury units, it would somehow result in more affordable housing. The fact is that the opposite is true. There is little doubt that the shortage of housing, and particularly affordable residences in New York City, is the result of the Rent Control Laws created through the emergency housing legislation after World War II. Another reason for the lack of housing supply is the creation of Stabilized Housing in the late 1960s. This legislation placed New York New York, state, United States New York, Middle Atlantic state of the United States. It is bordered by Vermont, Massachusetts, Connecticut, and the Atlantic Ocean (E), New Jersey and Pennsylvania (S), Lakes Erie and Ontario and the Canadian province of State on the road to contradicting the laws of supply and demand, and the post World War II housing shortages continue to plague New York seventy years later. After decades of limited ground-up housing development, and most of the activity during the early 1980s focusing on the conversions of rental properties, the City enacted the 421-a program as the incentive for new development. While residential developers started to build once again, they faced several challenges including, high cost of land and construction, community objections and the many rules and regulations imposed by numerous New York City government agencies. Today, the cost of developing a new residential property is so high, that when combined with soaring property taxes, is a venture some developers still shy away from Verb 1. shy away from - avoid having to deal with some unpleasant task; "I shy away from this task" avoid - stay clear from; keep away from; keep out of the way of someone or something; "Her former friends now avoid her" . To combat this, the 421-a program phases in the full real property taxes over ten years, and therefore makes development more affordable. With development costs continuing to climb, without the 421-a program, luxury housing would not be replaced by affordable housing, but rather no housing. The land would either remain underutilized or be used for commercial purposes. In either event, the end result would be less, rather than more housing. If 421-a tax abatement was to remain intact, over the next ten-year period the properties built under this program would produce the "full real property tax." And, since real property taxes are controlled by the City, this "full property tax" would result in more income and therefore could translate into more affordable housing. Building more luxury housing will allow New Yorkers currently living in existing units the opportunity to buy a new home. As a result, this would open up affordable housing for a new group of New Yorkers. The development of luxury housing would bring more option units into the market, which helps everyone. Rather than eliminate the 421-a program as it affects luxury housing, it would be sensible to require the developers, as a quid pro quo [Latin, What for what or Something for something.] The mutual consideration that passes between two parties to a contractual agreement, thereby rendering the agreement valid and binding. for the program, to rehabilitate substandard substandard, adj below an acceptable level of performance. housing units that already exist. The New York City Housing Authority The New York City Housing Authority (NYCHA) provides housing for low and moderate income residents throughout the five boroughs of New York City. NYCHA also administers a citywide Section 8 Leased Housing Program in rental apartments. controls the vast inventory of affordable residences that need substantial rehabilitation. Developers interested in building luxury condominiums can be required to renovate these buildings as part of the 421-a tax abatement program. In addition, since the City is also leaving the Mitchell-Lama plan due to its concerns over the substantial rehabilitation needed for properties under this program, the same developers could be persuaded to renovate these buildings and keeping them from leaving the program. Creating affordable housing is not a "we versus them" proposition. Rather, it is an issue which requires a creative approach and all parties to work together. With the City, developers and other real estate professionals putting their vast experience and capital into play and working together, they can create a plan for the future of affordable housing in New York City that can be brought to fruition.
