Editor: I am writing to express my concern over the content of the article entitled "E-signatures for an E-world," published in the January 2003 edition of State Legislatures.

Although I was pleased to see an article dealing with this subject, I was dismayed that the article fails to mention the troublesome questions of federal preemption raised by the Electronic Signatures in Global and National Commerce Act The Electronic Signatures in Global and National Commerce Act (ESIGN, Pub.L. 106-229, 14 Stat. 464, enacted 2000-06-30, ) is a United States federal law passed by the U.S.  (E-sign).

The article notes that states have the option of enacting the Uniform Electronic Transactions Act The Uniform Electronic Transactions Act (UETA) is one of the several United States Uniform Acts proposed by the National Conference of Commissioners on Uniform State Laws (NCCUSL). Since then 46 States, the District of Columbia, and the U.S.  with minimal modifications. It would have been pertinent to explain that any such modifications could trigger federal preemption under E-sign. As an attorney who has tried to explain how this preemption might apply to a state's attempt to regulate electronic commerce, I understand that this complex subject does not lend itself to a broad survey of the type exemplified by this article.

However, it is always important to alert legislators and their staff to important legal issues that are lurking behind their various options for legislation.
