The Evans have also claimed that their children's medical conditions worsened and they were emotionally damaged while in DCF custody.

Russell S. Adler, of Rothstein Rosenfeldt Adler, said, "DCF is supposed to have evidence of abuse or neglect BEFORE they take children away from their parents. DCF ignored the facts and acted recklessly by filing the dependency case against the Evans family. It has violated this family's constitutional rights."

California Physician, Dr. Mitchell Katz, who treated Emily and Jacob, stated in an Affidavit: "In my twenty nine (29) years of practicing pediatrics, I have been involved and diagnosed child abuse, child neglect and Munchausen's by Proxy.......and at no time have I ever suspected or believed that the welfare of both Jacob and Emily have been anything but the highest priority for Sara and Alex Evans."

Dr. Katz's remarks are echoed by two other prominent California doctors who also treated the Evans children.
