Large Florida homeowners insurer goes into receivership following hurricanes.

A member company of Florida's third-largest private homeowners insurer has been ordered into receivership by a state judge.

  • Leon County, Florida
  • Leon County, Texas
Circuit Court Judge Thomas Bateman Thomas Bateman (8 November, 1821 (baptised) - 28 August, 1861) was an English antiquary and barrow-digger.

Bateman was born in Rowsley, Derbyshire, the son of the amateur archaeologist William Bateman.

Another member company of Tampa, Fla.-based Poe--Atlantic Preferred Insurance Co.--was placed in receivership May 1. A third Poe company, Florida Preferred Insurance Co., is expected to be ordered into rehabilitation, and all face possible liquidation, according to according to

When a company is placed into liquidation, the Department of Financial Services continues as receiver, but the Florida Insurance Guaranty As a verb, to agree to be responsible for the payment of another's debt or the performance of another's duty, liability, or obligation if that person does not perform as he or she is legally obligated to do; to assume the responsibility of a guarantor; to warrant.  Association is tapped to help pay outstanding claims. The move to rehabilitation comes after the Office of Insurance Regulation found Southern Family had failed to meet state capital and surplus requirements. According to statute, a property/casualty insurer must have surplus of at least $4 million. In March, the OIR OIR Office of Institutional Research

ordered Southern Family to stop writing new and renewal business. Following that order, Poe's property/casualty subsidiaries stopped writing homeowners policies in Florida and began working on recapitalizing.

"The eight hurricanes put this company under," said Sam Miller Sam Miller is a British television director. He is best known for his work on the BBC television dramas Cardiac Arrest and This Life. [1]

Miller is a keen supporter of the South Sydney Rabbitohs Rugby League team.
, executive vice president of the Florida Insurance Council. "This company had a lot of exposure in coastal areas, and unfortunately the eight hurricanes (of 2004 and 2005) had a big effect on it."

Poe had more losses from Hurricane Wilma Hurricane Wilma was the most intense hurricane ever recorded in the Atlantic basin. Exceeding the 21 storms of the 1933 season, Wilma was the twenty-second storm (including the subtropical storm discovered in reanalysis), thirteenth hurricane, sixth major hurricane, and fourth , which struck southern Florida, than from the 2004 hurricanes combined. For Southern Family alone, Wilma caused 30% more claims than the 2004 hurricanes did. And the 2004 and 2005 hurricanes produced a combined loss of $2 billion, resulting from more than 125,000 claims. That's equivalent to one-third of the group's book of business reporting catastrophe claims.

"It should be no surprise that the activity from the 2004 and 2005 hurricane seasons has been substantial," Jim Wurdeman, Poe's president and chief executive officer, said in a statement.

In March of last year, A.M. Best Co. downgraded the financial strength ratings of Southern Family and Atlantic Preferred from B (Fair) to C (Weak). As requested by Poe Financial Group, the ratings for Southern Family and Atlantic Preferred were withdrawn and assigned an NR-4 (Company Request) classification. In addition, the NR-2 (Insufficient Size and/or Operating Experience) classification of Florida Preferred was revised to NR-4.

Poe is the second casualty of the hurricanes. In 2004, American Superior Insurance Co., a Plantation, Fla.-based homeowners insurer, was ordered into liquidation. The company had 60,000 policyholders.

Resolution Timeline

The Office of Insurance Regulation has suggested the following timeline for rehabilitation and liquidation for the three companies:

APRIL April: see month.  25--Southern Family placed into rehabilitation. Policyholders are encouraged to seek alternate coverage.

MAY 1--Atlantic Preferred placed into rehabilitation. Policyholders are encouraged to seek alternate coverage.

JUNE 1--If unable to obtain reinsurance The contract made between an insurance company and a third party to protect the insurance company from losses. The contract provides for the third party to pay for the loss sustained by the insurance company when the company makes a payment on the original contract. , Florida Preferred will be placed into liquidation. Policyholders are encouraged to seek alternate coverage.

JUNE 1--Southern Family and Atlantic Preferred will be placed into liquidation. Policyholders are encouraged to seek alternate coverage.

JUNE 30--Remaining policyholders with Southern Family, Atlantic Preferred and potentially Florida Preferred will be automatically covered by Citizens Property Insurance Corp. without any disruption in coverage, level of coverage or premium increase.
