LAW FIRM REACHES SETTLEMENT AGREEMENT WITH COUNTRY WALK DEVELOPER ON CLASS-ACTION BASIS IN CONSTRUCTION LAWSUITS

MIAMI, April 9 /PRNewswire/ -- The law firm representing homeowners at Country Walk has reached a class action settlement agreement with the community's primary developer, Arvida/JMB Partners, on behalf of its clients in the community.
According to Louis Robles, a partner in the Miami law firm of Robles & Gonzalez, clients who are the owners of single-family homes at Country Walk will receive approximately $7,500 each. In addition, condominium owners will each receive $4,500, a lesser amount because the settlement does not affect claims filed by condominium associations.
"The settlement also does not affect subrogation claims which were filed on behalf of insurance companies," said Robles.
"Arvida has shown good faith, and we're satisfied that our clients' best interests have been addressed in the settlement," said attorney Ervin Gonzalez. "Given the circumstances, it doesn't make sense to pursue litigation any further, and our recommendation has been for our clients to accept this settlement."
Country Walk, a 1,700-home community in South Dade, became a symbol for the devastation caused by Hurricane Andrew last August. Arvida/JMB Partners is one of three developers who built homes in Country Walk. Another developer, Kendall Country Estates, settled a similar suit last year, while a a lawsuit remains pending against the third developer, Weitzer Companies.
Robles & Gonzalez represented hundreds of homeowners in a similar lawsuit against Lennar Corp. That suit was settled in January.
"Even though these type of cases could conceivably go to trial, settlements are in the best interests of everyone involved, including the developer and the homeowners," Gonzalez said. "What's most important now is that we all work together to ensure the integrity of the building code, so this sort of thing doesn't happen again."
