``The facts are different,'' Deputy District Attorney Carlos Chung said of the differing convictions in 68-year-old Ladd Franklin Schweitzer's killing. ``Taylor was the actual shooter. Blakney kind of leaned back in the car seat as the actual shooter shot.'' Schweitzer, a Palmdale resident, was shot late on Aug. 22, 2002, after refusing to hand over his money to a gunman who had stopped his van on 70th Street East near Avenue N.
