Kubota Corp., Osaka, Japan, has filed a complaint against Daedong Industrial and its U.S. distributor Kioti Tractors, Wilson, N.C., charging trademark and trade dress infringement and unfair competition unfair competition n. wrongful, fraudulent and/or business methods to gain an unfair advantage over competitors, including: a) untrue or misleading advertising or promotion which misrepresent the nature, characteristics, qualities or geographic origin (such as where wine comes from), b) misleading customers by imitative trademark, name, or package, including trademark infringement, c) falsely disparaging another's product.. The lawsuit alleges that Kioti has engaged in trade dress infringement by using Kubota's distinctive orange color on its competing models of tractors. Kubota seeks injunctive relief injunctive relief n. a court-ordered act or prohibition against an act or condition which has been requested, and sometimes granted, in a petition to the court for an injunction. Such an act is the use of judicial (court) authority to handle a problem, and is not a judgment for money. and monetary damages against Kioti.
