Officials from the ITC, in-house counsel whose companies have been involved in section 337 investigations, and outside counsel with extensive experience with section 337 will highlight key considerations and best practices for planning and managing section 337 litigations.

The ITC decides intellectual property disputes involving imported goods under Section 337 of the Tariff Act. Patent holders receive much faster results before the ITC than in the district courts, with most proceedings scheduled for final determination within a year to 15 months. A patent holder that is successful before the ITC can obtain an exclusion order to shut competing infringers out of the U.S. market.

Marcia Sundeen chairs Kenyon & Kenyon's International Trade Practice Group and is based in the Washington DC office. She has over 20 years of experience litigating a wide variety of intellectual property disputes in both U.S. District Courts and the ITC. Ms. Sundeen was an attorney in the General Counsel's Office at the ITC and a Staff Attorney in the Office of Unfair Import Investigations at the ITC. She also is a recent past president of the ITC Trial Lawyers Association and is currently representing several companies in pending section 337 actions.
