Judge reprimands Windsor CAS on protective custody of young refugee.


WINDSOR -- An Ontario judge strongly reprimanded the Windsor-Essex Children's Aid Society

The Children’s Aid Society (CAS) is a private charitable organization based in New York City.
 for the lack of detail and lack of update of a care plan for a young Sudanese refugee when he dismissed the Society's motion for a continued protective order for the young man.

 said it "is nothing short of remarkable," that the society had submitted the same care plan for the young man that it submitted more than one year ago when it originally sought to make him a ward of the Crown.

Moreover, the judge noted that for most of the six-month wardship, the young refugee had been in jail as a result of ongoing criminal charges, but "no further detail is provided" by CAS, which the judge described as being "fundamentally incomprehensible to this court ...".

In the hearing, his lawyer noted that the boy wanted to move to Toronto where he could be closer to a larger Sudanese community, where there are resources and interpreters. In fact, the only interpreters in Ontario who speak his native language of Dinka reside in Toronto.

His counsel described him as feeling "persecuted" and his inability to communicate has caused a Significant degree of frustration for him, that "in no small measure, had contributed to" his numerous assault charges. In addition, he was unable to receive an education in the language he understood.

Although the judge dismissed the motion for ongoing protective custody he allowed the status review application of the boy to remain outstanding.
