U.S. Appeals Court

CONSENT DECREE A settlement of a lawsuit or criminal case in which a person or company agrees to take specific actions without admitting fault or guilt for the situation that led to the lawsuit.

A consent decree is a settlement that is contained in a court order.

 -- Prison Litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

When a person begins a civil lawsuit, the person enters into a process called litigation.

Jones-El v. Berge, 374 F.3d 541 (7th Cir. 2004). Prisoners of a "supermax" prison brought a suit challenging their conditions of confinement. After the plaintiff class was certified and a preliminary injunction A temporary order made by a court at the request of one party that prevents the other party from pursuing a particular course of conduct until the conclusion of a trial on the merits.

A preliminary injunction is regarded as extraordinary relief.
 was entered, a consent decree was approved by the court. The prisoners subsequently moved to enforce the decree. The district court entered an order directing the installation of air conditioning and the defendants appealed. The appeals court affirmed, finding that the district court's order was not a grant of "prospective relief" that was subject to the requirements of the Prison Litigation Reform Act (PLRA).
