Jack Benun, President, of Jazz:
This is just the latest attempt by Fuji to keep us from
competing fairly in the American marketplace for the
benefit of consumers. It is ironic that Fuji, through the
use of the considerable political influence it wields as
one of Japan's largest companies, has now enlisted U.S.
Customs, a unit of the Department of Homeland Security, in
it's efforts to destroy our company.
Mr. Benun noted that as recently as November 17, 2004 the Court of International Trade had ruled, as have all other forums that have rendered non-appealable judgments, that Jazz's reloading Reloading A term lenders commonly use to refer to the habits of borrowers taking out loans to repay the balance on other loans. Often reloading is done to take advantage of lower interest rates offered by other loans, and potential tax benefits. of used camera shells collected from U.S. photo processors does not violate Fuji's patents. Nonetheless, Mr. Benun said, U.S. Customs has summarily continued to exclude our products without undertaking legally mandated inspections. We have filed protests and submitted to Customs voluminous information demonstrating that our cameras are admissible (algorithm) admissible - A description of a search algorithm that is guaranteed to find a minimal solution path before any other solution paths, if a solution exists. An example of an admissible search algorithm is A* search. , but Customs has ignored this information and summarily denied our protests causing us to commence actions against the Government to secure the cameras' release. Mr. Benun feels these actions in the service of Fuji, a foreign company, represent a subversion of the process of an agency created to protect U.S. interests. Jazz is an importer and distributor of single use, 35 mm and zoom cameras in the United States, Canada and Europe. |
