Tuffree told investigators that Clark fired first after Tuffree raised his handgun at the kitchen window. Tuffree said he returned the gunfire, which fatally wounded Clark.

``I backed up and pointed it in his direction and he started firing,'' Tuffree said on the tape. ``I never intended to kill anybody.''

When Clark knocked at the front door, Tuffree said he attempted to hide. Tuffree said he got his gun after Clark entered his side-yard patio.

The two met at the kitchen window. Tuffree said he held the handgun in his left hand on the kitchen counter and out of Clark's view.

``I didn't want any kind of incident,'' he said. ``I didn't lift it up. I left it right on the counter with my hand on it. And I did not fire first.''

The confrontation turned deadly when Clark told Tuffree to raise both hands. Tuffree said he showed the gun ``to just intimidate him to leave.''

``And he immediately backed up and drew his gun and fired in through the window,'' Tuffree said.
