JURORS ASKED TO OVERLOOK VICES; DALLY DEFENSE SAYS FLAWS DON'T MAKE HIM A MURDERER.

Byline: Don Holland Daily News Staff Writer

In their final summation summation n. the final argument of an attorney at the close of a trial in which he/she attempts to convince the judge and/or jury of the virtues of the client's case. (See: closing argument)  before jury deliberations begin, attorneys for Michael Dally, accused in his wife's murder, said Thursday that his unconventional lifestyle - including his penchant for prostitutes and drugs - do not make him a killer.

``Just because he is not a good person, just because he frequents prostitutes, just because he smokes rock cocaine . . . just because of all those things, does not make a murderer,'' defense attorney James Farley

For other people named James Farley, see James Farley (disambiguation).

James (Jim) Aloysius Farley (May 30, 1888–June 9, 1976) was an American politician who served as head of the Democratic National Committee and Postmaster General.

Since his trial began Feb. 9, Dally's life has been under a magnifying glass magnifying glass: see microscope.

``Everything that Michael Dally did, every word he ever uttered is being used against him in this trial,'' he added.

But ultimately, Farley said, prosecutors have proven only two things: that Dally's lover, Diana Haun, killed Sherri Dally and that Michael Dally is not a very good man.

``But you need more than that to convict To adjudge an accused person guilty of a crime at the conclusion of a criminal prosecution, or after the entry of a plea of guilty or a plea of nolo contendere. An individual who has been found guilty of a crime and, as a result, is serving a sentence as punishment for the act;  that man of anything - anything at all,'' Farley said.

Dally, 37, is accused of murder for financial gain, kidnapping kidnapping, in law, the taking away of a person by force, threat, or deceit, with intent to cause him to be detained against his will. Kidnapping may be done for ransom or for political or other purposes.  and conspiracy in the May 1996 murder of his wife, Sherri. Haun was convicted of those charges and is now serving a life sentence. And although Dally maintained a close relationship with Haun even after she was arrested for Sherri Dally's murder, Farley said his client was duped - just as Haun's other lovers were duped by her beguiling ways.

``Where is the evidence in this case . . . that in any way connects Michael Dally and Diana Haun in a conspiracy in this case?'' Farley said.
