JUDGE THROWS OUT OFFICER'S LAWSUIT AGAINST RIORDAN.

A Superior Court judge has sent out his decision to quash a lawsuit filed by LAPD 1. LAPD - Link Access Procedure on the D channel.
2. LAPD - Los Angeles Police Department.
 Sgt. Ronnie Cato that accused Mayor Richard Riordan Richard J. Riordan (born May 1, 1930) is a Republican politician from California, U.S. who served as the California Secretary of Education from 2003–2005 and as Mayor of Los Angeles from 1993–2001. Riordan ran for Governor of California unsuccessfully in 2002.  of defamation for calling Cato a racist.

Riordan made the comment about Cato last year after becoming angered when Cato publicly criticized Deputy Chief Mark Kroeker as not being a good candidate for Los Angeles Los Angeles (lôs ăn`jələs, lŏs, ăn`jəlēz'), city (1990 pop. 3,485,398), seat of Los Angeles co., S Calif.; inc. 1850.  police chief.

In a decision received Thursday by the city, Judge Ernest Hiroshige ruled that Cato had voluntarily injected himself into a public controversy by writing a letter to the Police Commission that accused Kroeker of not being fair to African-American police officers.

``Therefore, as a limited public figure he must prove the mayor's comment was made with actual malice Actual malice in United States law is a condition required to establish libel against public figures and is defined as "knowledge that the information was false" or that it was published "with reckless disregard of whether it was false or not.  - this he failed to do,'' the judge wrote in the decision.
