JUDGE IMPOSES 30-FOOT BUFFER PEDOPHILE ORDERED TO AVOID KIDS' SPOTS.

CHATSWORTH -- A judge on Friday issued a three-year order barring self-proclaimed pedophile pedophile Forensic psychiatry A person with pedophilia; there are an estimated 500,000 pedophiles in the world. See Child prostitution, Megan's law, Pedophilia.  Jack McClellan Jack McClellan is a self-proclaimed pedophile and pro-pedophile activist who became embroiled in a series of controversies beginning in June 2007 over his visits to public venues and events in which young girls are likely to be present, and his photographing such venues and events  from coming within 30 feet of areas where children gather, pleasing attorneys and family groups who fought to keep the 45-year-old vagabond VAGABOND. One who wanders about idly, who has no certain dwelling. The ordinances of the French define a vagabond almost in the same terms. Dalloz, Dict. Vagabondage. Revising his earlier court order that barred McClellan from approaching children anywhere in the state, Superior Court Judge Melvin D. Sandvig said the new ruling was constitutional and would allow McClellan to carry on a normal life.

"Minor children need extra protection," Sandvig said before a packed and tense gallery that included parents who said McClellan's Internet postings may have enticed other pedophiles to events attended by their children.

"I don't believe there are any constitutional violations here," Sandvig said. "This order is for the protection of minor children and for Mr. McClellan also."

The new ruling effectively prevents McClellan from coming within 30 feet of such places as schools, playgrounds and child-care centers.

McClellan was arrested Aug. 13 and charged with violating the earlier court order after he was spotted with a camera near a UCLA UCLA University of California at Los Angeles

 child-care center, and then returned to the campus after being told to leave.

The City Attorney's Office later dropped a misdemeanor charge and he was released from jail.

Attorneys were prepared to press contempt-of-court charges against McClellan in connection with the UCLA incident, but decided not to after Sandvig's ruling Friday.

The attorneys, who brought the civil actions against McClellan, called Sandvig's decision "fair and just."

"The order creates a safe perimeter around children ... but it does not bar him from having a life," said Anthony D. Zinnanti, the Valencia co-counsel whose daughter is a plaintiff in the case.

McClellan, who wore a multicolor rugby-style shirt and dark sweat pants, was flanked by sheriff's deputies and news camera crews as he left the Chatsworth courthouse.

'Left in the lurch'

He struggled through the crowd outside the courthouse to the car he says he lives in, and drove off.

Asked whether he understood the order and would stay away from children, he appeared to nod.

He didn't respond to questions about whether he might leave California.

Richard A. Patterson, the other co-counsel with a daughter as a plaintiff, said the lawyers met with McClellan after the ruling and said they believe he understands what's expected of him.

, and we said, 'Yes,'" Patterson said. "We have the impression he will abide by it, and we've offered him (mental health) assistance."

Daily activities

The order would allow McClellan to do regular, daily activities such as shopping and going to the movies, the attorneys said.

While McClellan has never been convicted of a crime involving pedophilia pedophilia, psychosexual disorder in which there is a preference for sexual activity with prepubertal children. Pedophiles are almost always males. The children are more often of the opposite sex (about twice as often) and are typically 13 years or age or younger;  acts, the judge said the civil restraining order restraining order: see injunction.  is based on McClellan's past activities, including posting pictures of children on the Internet and listing child-friendly locations for other pedophiles.

The permanent order prohibits McClellan from photographing, videotaping, posting on the Internet or otherwise recording images of minor children without the written consent of a parent or guardian.

Lena Smyth, co-founder of Mothers Against Sexual Predators of California, said legislation still is needed to tighten restrictions on sexual predators.
