JUDGE DENIES BID TO DELAY LANDFILL PLAN.Byline: Michael Coit Daily News Staff Writer Opponents of the Toland Road Landfill expansion failed Friday to delay the project when a judge denied their motion for a preliminary injunction A temporary order made by a court at the request of one party that prevents the other party from pursuing a particular course of conduct until the conclusion of a trial on the merits. A preliminary injunction is regarded as extraordinary relief. until seismic questions are resolved. Superior Court Judge Joe Hadden ruled against the cities of Fillmore and Santa Paula Santa Paula (săn`tə pôl`ə), city (1990 pop. 25,062), Ventura co., S Calif., on the Santa Clara River in a fertile valley that yields citrus fruits, avocados, vegetables, flowers, nursery products, and walnuts; laid out 1875, inc. , the Santa Clara Santa Clara, city, Cuba Santa Clara (sän`tä klä`rä), city (1994 est. pop. 217,000), capital of Villa Clara prov., central Cuba. School District and a group of growers after a three-hour hearing, a court official said. Attorneys for the opponents sought the preliminary injunction to prevent the landfill from being expanded until legal challenges are settled. They argued that the administrative process is incomplete and claimed the Santa Clara River Valley The Santa Clara River Valley is a rural region of eastern Ventura County, California and northwest Los Angeles County, California that is named for the Santa Clara River which winds through the valley before emptying into the Pacific Ocean between the cities of Oxnard and Ventura. would be irreparably harmed if the landfill was expanded before seismic studies are completed. Ventura Regional Sanitation District officials contended the approval process was completed July 30 when the California Integrated Waste Management Board approved a solid-waste facilities permit. The sanitation district previously received permits from the Ventura County Board of Supervisors The examples and perspective in this article or section may represent an unduly geographically limited view of the subject. Please [ improve this article] or discuss the issue on the talk page. The Board of Supervisors is the body governing counties in the U.S. and a waste discharge permit from the Regional Water Quality Control Board. The sanitation district wants to expand dumping from 135 tons to 1,500 tons per day. The expansion is projected to boost the lifetime capacity of the landfill from 2.5 million tons to 15 million tons over 31 years. Toland Road Landfill opened in 1970 to serve Fillmore, Santa Paula and the unincorporated county. With the expansion, it replaces Bailard Landfill - which closed Aug. 24 - as the west county's main dump. Santa Clara River Valley residents fear the larger dump would foul the agricultural area with truck traffic, noise, dust and would pollute air and groundwater. While those fears failed to block the various state and local approvals, opponents contend a recent report by an Oregon State University Oregon State University, at Corvallis; land-grant and state supported; coeducational; chartered 1858 as Corvallis College, opened 1865. In 1868 it was designated Oregon's land-grant agricultural college and was taken over completely by the state in 1885. geologist raises new questions about the project's viability. The report prompted the regional water quality board to issue a permit that prohibits trash disposal within 200 feet of a potentially active earthquake fault until further study is done. Hadden is the fifth judge to handle the controversial suit. He took over two weeks ago, when Judge Ken Riley Kenneth Jerome Riley (born August 6 1947) is a former professional American Football defensive back who played his entire career for the Cincinnati Bengals, in the American Football League in 1969 and in the NFL from 1970 through 1983. excused himself, citing a possible conflict of interest. Riley told attorneys he had supported Fillmore Mayor Roger Campbell's unsuccessful supervisorial bid in the March primary, and the landfill expansion was an issue in the campaign. Last week, Hadden told the sanitation district it could expand daily dumping until he ruled on the motion for a preliminary injunction. |
