JENKENS & GILCHRIST ADDS TEN ATTORNEYS IN AUSTIN.


AUSTIN, Texas--(BUSINESS WIRE)--Jan. 17, 1995--Ten attorneys practicing in governmental affairs, administrative law administrative law, law governing the powers and processes of administrative agencies. The term is sometimes used also of law (i.e., rules, regulations) developed by agencies in the course of their operation. , corporate/securities law, and intellectual property have joined JENKENS & GILCHRIST, A Professional Corporation, in Austin.

"Jenkens & Gilchrist has a statewide reputation for serving the needs of growing and established businesses. This group of veteran lawyers will allow us to expand our practice in governmental affairs and administrative law and will add to the resources we offer to technology businesses," said Jenkens & Gilchrist Chairman David M. Laney, announcing the move. Previously, all 10 attorneys were with Johnson & Wortley, a Dallas-based firm which voted to dissolve December 29.

"Our group had the good fortune to have several alternatives, and we chose this firm," Galt Graydon said. "We wanted a firm with a solid reputation that would have instant credibility with our clients and proven ability in the range of services they need. We are delighted to be joining Jenkens & Gilchrist."

Attorneys joining Jenkens & Gilchrist in Austin are:

Governmental Affairs: Galt Graydon as a shareholder and Gray T. Newton as special counsel, and Machree Garrett Gibson (currently Assistant Secretary of State for the State of Texas) as an associate;

Administrative Law: Michael G. Shirley, Patricia A. Bowers and John H. Bucy II as shareholders;

Corporate/Securities Law: J. Rowland Cook and Kathryn K. Lindauer as shareholders and Carol Bellon as an associate; and

Last week Johnson & Wortley's Intellectual Property Practice Group announced it would move to Jenkens & Gilchrist. Of that move, Laney said: "The addition of the intellectual property practice group, which specializes in information technology, compliments our existing practice." With the recent additions, Jenkens & Gilchrist's Intellectual Property Section now includes 22 attorneys. The group represents some of the nation's leading technology companies, including AMD (Advanced Micro Devices, Inc., Sunnyvale, CA, www.amd.com) A major manufacturer of semiconductor devices including x86-compatible CPUs, embedded processors, flash memories, programmable logic devices and networking chips. , Dell, Eastman Kodak and Ericsson Radio Systems.

J. Rowland Cook Shareholder, Corporate/Securities

Mr. Cook's primary area of practice is corporate and securities law. He represents clients in a range of corporate finance and securities matters, with emphasis on public and private capital formations; venture capital investments; mergers and acquisitions; partnerships, syndications and related tax matters; SEC compliance; broker-dealer matters; tender offers; control contests; software licensing; and technology transfer agreements. Previously, he served as Assistant Attorney General of Texas in the Insurance, Banking and Securities Department; in various counsel positions in the Division of Corporate Finance at the US Securities and Exchange Commission; and as administrative/legislative assistant to US Representative J.J. Background, Practice Summary Intellectual Property Practice Group

Following is a description of the capabilities of the group of attorneys comprising the Jenkens & Gilchrist Intellectual Property Section.

Approach. The Intellectual Property Section interacts with other specialized practice groups within Jenkens & Gilchrist to relate the fundamental intellectual property practice with other groups to provide cost-effective, seamless service delivery for technology-based companies. Services include assistance in creation and exploitation of valuable intellectual property assets and enforcement of rights to intellectual property.

Attorneys from the Section will work in tandem with Jenkens & Gilchrist's practice groups, including venture capital, corporate/securities and litigation sections to provide an integrated approach to legal service.

Fields of Law. The Intellectual Property Section includes lawyers who practice in the following fields of law:

- Patents

Patentability, infringement and validity searches and studies; assistance to clients designing around patents; preparation and prosecution of patent applications; consultation on corporate asset protection policy; and consultation on tax and working requirements for maintenance of patent properties worldwide.

- Trademarks

Conducting trademark and service mark searches; rendering registration and infringement opinions; preparing and prosecuting applications for trademark and service mark; conducting opposition and cancellation proceedings; and counseling regarding the selection, use, protection and enforcement of trademark and service mark properties.

- Copyrights

Counsel regarding copyrightability; advice regarding copyrighting computer software; applications for registration; advice regarding entertainment law matters.

- Trade Secrecy

Counsel regarding business and technical subject matter; advice regarding patentability; design of protection programs for trade secrets.

Exploitation of Intellectual Property. An integrated approach to transactions is particularly helpful in the exploitation of the value of intellectual property; the Section works on commercial transactions, including mergers, acquisitions and joint ventures involving intellectual property assets. Section experience includes negotiation of domestic and foreign patent, trademark, copyright and know-how licensing agreements and employment agreements involving confidentiality and post-employment restrictions.

Enforcement of Intellectual Property. The Section has conducted litigation including patent, trademark, service mark and copyright infringement litigation, trade secret misappropriation misappropriation n. the intentional, illegal use of the property or funds of another person for one's own use or other unauthorized purpose, particularly by a public official, a trustee of a trust, an executor or administrator of a dead person's estate, or by any , and litigation involving agreements of all kinds relating to intellectual property.
