Iran-Iraq conflict; chemical weapons use condemned in Security Council.


The Security Council on 9 May vigorously condemned the continued use of chemical weapons in the conflict between Iran and Iraq, contrary to obligations under the 1925 Geneva Protocol Geneva Protocol: see protocol.

In unanimously adopting resolution 612 (1988), the Council also expressed its expectation that both sides would "refrain from the future use of chemical weapons in accordance with their obligations under the Geneva Protocol".

Under the text (S/19869)-put forward by the Federal Republic of Germany, Italy and Japan-States were called upon to "continue to apply or to establish strict control of the export to the parties to the conflict of chemical products serving for the production of chemical weapons".

The Council acted after reviewing a 14 April report of a mission sent by Secretary-General Javier Perez de Cuellar Pé·rez de Cuél·lar   , Javier Born 1920.

 to investigate allegations of the Governments of both Iran and Iraq of the use of chemical weapons in the conflict. The mission found that chemical weapons had again been used in both Iran and in Iraq and that there had been an apparent increase in the number of civilian casualties Civilian casualties is a military term describing civilian or non-combatant persons killed or injured by military action. Awesome prospect

The Secretary-General said that such use could further escalate and seriously undermine the 1925 Geneva Geneva, canton and city, Switzerland

 Protocol-a document which for 60 years "has been a hopeful symbol of mankind's desire and its ability to mitigate the effects of war through universal adherence to humanitarian concerns". That was an "awesome prospect", which the international community must resolve through concrete steps and, above all, "concerted exercise of determined political will to prevent it from becoming a reality".

In transmitting the report to the Council on 25 April the SecretaryGeneral expressed his "deep sense of dismay and foreboding" at its conclusion. The specialist had visited Iran from 28 to 31 March and Iraq from 8 to 11 April.

Mr. Perez de Cuellar strongly urged the parties concerned and all Governments "seriously to weigh the full implications of the present report for our common future".

His paramount objective was to bring the "long and tragic conflict" between Iran and Iraq to the earliest possible end. He recalled Council resolution 598, adopted on 20 July 1987, which aimed at a comprehensive settlement of the conflict, and deplored the violation of international humanitarian law International humanitarian law (IHL), also known as the law of war, the laws and customs of war or the law of armed conflict, is the legal corpus "comprised of the Geneva Conventions and the Hague Conventions, as well as subsequent treaties, case law,  and other laws of conflict, in particular, the use of chemical weapons.

Dr. Dominguez participated in four previous missions sent to Iran and to Iraq between 1984 and 1987 to investigate allegations of chemical weapons use.

Iran reaction

On 27 April, Iran expressed disappointment with the report which it said failed to "address the crime in a clear and unambiguous tone". The Secretary-General should "determine the responsibility for these latest resorts to chemical warfare", Iran added. The Security Council must compel Iraq to respect internationally recognized rules of warfare. The SecretaryGeneral should establish a permanent team in Teheran and Baghdad to investigate the extent of and responsibility for, future uses of chemical weapons.

Another mission: On 28 June, the Secretary-General announced he was sending at the request of the Security Council, a three-member expert mission to Iran to investigate recent allegations of the use of chemical weapons. Iran had asked for such a mission on 25 May and again on 15 June.

Mission members were DE Dominguez; Erik Dahlgren, a research chemist and Head of Division of the Swedish National Defence Research Institute; and M.V. Berasategui, a national of Argentina, who serves in the Department of Disarmament Affairs at the United Nations Office in Geneva.
