Intelli-Check Files Patent Infringement Suit Against CardCom Technology.

The suit, filed in U.S. District Court for the Eastern District of New York, maintains that CardCom infringes on Intelli-Check's patent for its state-of-the-art ID-CHECK technology relating to its authentication system for document identification. The suit also maintains that CardCom, the manufacturer of the ViAge(R) age verification system and related products, committed acts of infringement "including, but not limited to, making, having made, using, causing others to use, selling and marketing patented methods, products and systems." The Intelli-Check Complaint also includes a claim that CardCom induced other parties to infringe the Intelli-Check patent by its sales and marketing activities. Intelli-Check seeks an unspecified amount of compensatory damages from CardCom and injunctive relief.

"We will more forcefully take action to protect Intelli-Check's intellectual property portfolio as a result of a continuation patent that we recently received from the U.S. Patent and Trademark Office," stated Frank Mandelbaum, the Company's Chairman and Chief Executive Officer. "With our own patents and those acquired through our September 2001 acquisition of the IDentiScan Company, Intelli-Check now has multiple patents in both the U.S. and Canada, together with trademarks and copyrights."

Intelli-Check currently holds four patents with three others pending and specifically maintains that CardCom is in violation of its U.S. Patent No. 6,463,416 B1, a continuation patent issued on Oct. 8, 2002. The continuation patent is broader in scope than its parent, which was granted to the Company on Jan. 26, 1999 as U.S. Patent No. 5,864,623. The technology described in the patent includes the ID-CHECK unit's capacity to validate the information encoded on all currently issued driver licenses and state-issued and military ID cards that conform to the uniform standards established by the American Association of Motor Vehicle Administrators The American Association of Motor Vehicle Administrators (AAMVA) is a non-governmental, voluntary, tax-exempt, nonprofit educational association.
