Intellectual property rights: keep your bases covered. (Speakers Directory).


U.S. copyright law has been in existence almost a century. Patent and trademark regulation precedes that by more than 100 years. Plagiarism Using ideas, plots, text and other intellectual property developed by someone else while claiming it is your original work.  is an issue most people learn about when they are assigned their first research paper in school. So why is intellectual property such a hot button now? Very simply, the Internet.

The Internet has created a heightened awareness of material that is "fair use" and that which infringes on copyrights. This increased awareness is leading to closer inspection of all potential intellectual property violations, including speakers' materials at association conferences and seminars.

If a speaker hired by an association uses a musical or video clip A short video presentation. , a cartoon, or even a "top 10" list that is copyrighted by someone else, the speaker could be held liable for infringement if he or she has not obtained permission for such use. And if the association has not secured a contract holding the speaker solely responsible and indemnifying the association from all liability, the owner of the copyright may target litigation An action brought in court to enforce a particular right. "And be sure to check references. See if clients have been happy with performances and how professional the speakers are. Confirm that speakers belong to the National Speakers Association or have other professional affiliations."

Some organizations are focusing on details to make sure speakers' presentations are in full compliance with intellectual property law. Marsha Flanagan, senior vice president of professional development and strategic events for Meeting Professionals International, Dallas, says MPI MPI - Message Passing Interface  requires that every presentation slide or page of a handout bear a copyright notice of the source if the material is not an original creation of the speaker. The clause in MPI's speaker contract goes even further to limit questionable endorsements, compelling the speaker to "agree and state that all materials and content presented...do not infringe in·fringe

Working with the intermediary of speakers bureaus can change the dynamics of contracts, says Barbara Dunn, an attorney with Howe & Hutton, Ltd., a firm with offices in Washington, D.C., Chicago, and St. Louis. "Sometimes groups don't see the contract the speaker signs with the bureau. The bureau trusts the speaker; the association trusts the bureau," she says. In such cases, the association should be sure to look for contract verbiage verbiage - When the context involves a software or hardware system, this refers to documentation. This term borrows the connotations of mainstream "verbiage" to suggest that the documentation is of marginal utility and that the motives behind its production have little to do with  that indemnifies the hiring association in the event of any claim of intellectual property infringement by the speaker.

Flanagan handles the issue with a contract that the speakers bureau must sign in addition to the contract most speakers bureaus provide to associations. "It's a 'you sign ours and then we'll sign yours' approach," she says.

These tapes and broadcasts are subject to additional copyright permissions and licensing fees for musical use. Even if a speaker has obtained all the necessary consents for material and paid all the music licensing fees for his or her presentation, the association must get additional permissions and pay separate fees for reproductions in audio or video form.
