India : BOMBAY HC provides relief to major telcos.

Providing some relief to India's major telco Bharti Airtel the Bombay High Court has ordered a stay over the one-time spectrum fee enforced by the Department of Telecommunications (DoT) for the auction of 2G spectrum.

The court has offered Airtel the stay until February 24. DoT started issuing demand notices to the operators, early this month.

Idea Cellular, Aircel also got some relief after the court on Monday stayed the enforcement of the one-time fee on the operator till March 1, 2013.

EGoM headed the finance minister P Chidambaram had proposed that existing operators would pay one-time fee for spectrum they hold over 4.4MHz.

The cabinet had taken a decision that for all spectrum holdings beyond 4.4 MHz (GSM), a onetime charge be imposed prospectively upon the incumbent operators at 2012 auction fixed price.

The date of applicability of the charge shall be the date of start of the first quarter after the date of the Cabinet decision.
