Important Upcoming Dates for 800 MHz Band Reconfiguration.

WASHINGTON -- As scheduled in the Regional Prioritization Plan ("RPP"), several important dates within the reconfiguration process are rapidly approaching:

* Wave 2, Stage 2 - Mandatory negotiations concludes on January 31, 2007 and Alternative Dispute Resolution (ADR) commences on February 1, 2007.

* Wave 3, Stage 2 - Voluntary negotiations concludes on January 31, 2007 and mandatory negotiations commence on February 1, 2007.

* Wave 4, Stage 2 (Non-Border Licensees) - The deadline for Request for Planning Funding (RFPF) submissions is February 1, 2007 for licensees in the non-border areas that have received a Frequency Proposal Report (FPR) from the TA before December 18, 2006.

Wave 2, Stage 2 - End of mandatory negotiations, beginning of ADR

If a licensee has not come to an agreement with Sprint Nextel on a Frequency Reconfiguration Agreement ("FRA") and submitted the FRA to the TA by the end of the mandatory negotiation period on January 31, 2007, a TA Mediator will conduct mediation. The TA is committed to supporting the parties throughout the mediation process and encourages licensees with questions or concerns to bring these to the attention of the mediator at the outset of the process. Wave 3, Stage 2 - End of voluntary negotiations, beginning of mandatory negotiations

The mandatory negotiation period, starting on February 1, 2007 and lasting three months, immediately follows the voluntary negotiation period. During the mandatory negotiation period, all parties are required to negotiate in good faith, and either party may request TA involvement to help reach an FRA or Planning Funding Agreement (PFA) through mediation.

Wave 4, Stage 2 - Deadline for Request for Planning Funding (RFPF) submissions for non-border area licensees

Licensees in Wave 4, Stage 2 that received an FPR from the TA prior to December 18, 2006 and who require funding for planning activities must submit an RFPF, together with supporting documentation, to the TA by February 1, 2007. Those licensees who received an FPR after December 18, 2006 will have 45 calendar days from the date of the cover letter accompanying the FPR (see the TA's press release of January 19, 2007).

RFPF deadlines are necessary to ensure that reconfiguration proceeds on schedule per the FCC's Report and Order. If you miss the deadline, you should incorporate any necessary planning costs into the Cost Estimate for the FRA. Planning funding requests submitted after the deadline must be accompanied by an explanation as to why funding is required prior to negotiating an FRA.

Licensees have many resources at their disposal to assist in reconfiguration activities. The TA's website (www.800TA.org) maintains the latest guidance regarding the process and milestones. In addition, there are members of the Public Safety community working for the TA who are available to assist licensees with efforts to complete activities within the process - either via phone or in face-to-face settings. About the 800 MHz Transition Administrator, LLC 

800 MHz Transition Administrator, LLC ("TA LLC") is the Transition Administrator ("TA") for the reconfiguration of the 800 MHz band mandated by the Federal Communications Commission ("FCC"). TA LLC has contracted with BearingPoint, Inc., Squire, Sanders & Dempsey L.L.P. and Baseline Telecom, Inc. to perform the duties of the TA. Among its duties, the TA establishes reconfiguration guidelines, specifies replacement channels, reviews reconfiguration cost estimates, monitors payment of reconfiguration costs, manages the relocation schedule, facilitates issue resolution and administers the alternative dispute resolution process. TA LLC uses information it receives solely for the purposes of administering the 800 MHz reconfiguration process and may disclose such information to the FCC or other authorized parties pursuant to the requirements of the 800 MHz Order or other applicable laws.
