Illinois Court Awards Dimplex Enhanced Patent Damages and Enters Permanent Injunction against CFM Corporation.

 -- Dimplex North America North America, third largest continent (1990 est. pop. 365,000,000), c.9,400,000 sq mi (24,346,000 sq km), the northern of the two continents of the Western Hemisphere.  Limited announced today that the US District Court for the Northern District of Illinois in Chicago has ruled in its favor on several post trial motions and has entered final judgment for damages in the amount of US $12.4 million in favor of Dimplex in its patent infringement patent infringement n. the manufacture and/or use of an invention or improvement for which someone else owns a patent issued by the government, without obtaining permission of the owner of the patent by contract, license or waiver.  suit against CFM and Vermont Castings.

The jury in the case previously found in March 2005 that CFM willfully willfully adv. referring to doing something intentionally, purposefully and stubbornly. Examples: "He drove the car willfully into the crowd on the sidewalk." "She willfully left the dangerous substances on the property." (See: willful)  infringed Dimplex's US Patent No. 5,642,580 (the '580 patent) by manufacturing and selling electric fireplaces and stoves that use Dimplex's patented technology, and awarded Dimplex compensatory damages A sum of money awarded in a civil action by a court to indemnify a person for the particular loss, detriment, or injury suffered as a result of the unlawful conduct of another.  of US $8.3 million.

By its order of May 11, 2005, the court awarded Dimplex enhanced damages of US $4.1 million citing CFM's willful conduct by continuing to manufacture and sell the infringing products for four years after first having been put on notice of infringement. In addition, the court issued a separate order denying CFM's claim that the '580 patent is unenforceable and entered a Permanent Injunction permanent injunction n. a final order of a court that a person or entity refrain from certain activities permanently or take certain actions (usually to correct a nuisance) until completed.  precluding CFM from selling more than 165 models of electric fireplaces and stoves that infringe the '580 patent.

Dimplex has filed suit against CFM on the same patented technology in Canada, and that case is due to go to trial in September 2005 in Toronto.
