An entity related to the borrower currently owns the hotel property that abuts the site and had 118,675 s/f of excess air rights. The lots were merged, and through a Zoning Lot Development and Easement easement, in law, the right to use the land of another for a specified purpose, as distinguished from the right to possess that land. If the easement benefits the holder personally and is not associated with any land he owns, it is an easement in gross (e.g. Agreement, the excess air rights and the right to cantilever were transferred to 310 West 52nd Street. This expanded the property's as-of-right floor area to 187,754 s/f and increased its tower floor plates.
