The district court dismissed the action, finding that the investigator was entitled to qualified immunity Qualified immunity is a doctrine in United States law providing immunity from suit to government officials performing discretionary functions when their action did not violate clearly established law. Qualified immunity was created by the U.S.  because it was not clearly established, at the time of the alleged incident, that he could not constitutionally require a parolee to take a lie detector test lie detector test n. a popular name for a polygraph which tests the physiological reaction of a person to questions asked by a testing expert. A potential or actual criminal defendant or possible witness cannot be forced or ordered to take a lie detector test. . (Illinois)
