A jury entered a verdict in favor of the inmate and awarded damages. The damage award was reduced to $165,000 and the detainee's attorney fees were calculated. The defendants moved for reconsideration of the attorney fee award, under the provisions of the Prisoner Litigation Reform Act (PLRA). The district court held that it had miscalculated the attorney fee award and entered a new award. The court held that PLRA limited the hourly rate to 150% of the current rate allowed under the Criminal Justice Act, and required the prisoner to pay 25 percent of his damages award to cover a portion of the award of attorney fees.
