This civil action was originally filed in August 1995 by Key against Hercon alleging that Hercon's submission to the United States Food and Drug Administration United States Food and Drug Administration (FDA),

Hercon had counterclaimed that Key's patent was invalid and unenforceable and that Hercon had not infringed any claim of the patent.

Health-Chem and Transderm are currently reviewing their options in this matter, including an appeal of this decision, which appeal would be filed within 30 days of the ruling.
