Just after 1 a.m. on February 16, 84-year-old Robert Birthwhistle of Mishawaka, Indiana Mishawaka (IPA: [ˈmɪʃ.ʌ.ˌwɒ.kʌ]) is a city on the St. Joseph river and a twin city of South Bend in St. Joseph County, Indiana, United States. Birthwhistle, who had been robbed at least three times in the preceding two years, believes that Rosebush had robbed him before, including involvement in an incident where a criminal convinced Birthwhistle to open his door and then put him in a headlock and robbed him.

When asked by the Tribune if he was worried about future break-ins, Birthwhistle replied, "At my age, I only have about ten or twenty years TWENTY YEARS. The lapse of twenty years raises a presumption of certain facts, and after such a time, the party against whom the presumption has been raised, will be required to prove a negative to establish his rights.
