He'll face judgment.

An 80-year-old man was killed, but he managed to wound his attacker, precipitating the arrest of a suspect.

Halloween night turned out to be the last night on Earth for 80-year-old Charlie Newman, a WWII and Korean War veteran. Newman was stabbed multiple times and shot once. He bled to death.

At 7:35 p.m., Newman dialed 911, but he didn't speak directly into the phone. By enhancing the audiotape of the call, police were able to make out what happened when Newman was killed. Police heard Newman tell a younger man that he needn't go through with his crime. Then they heard "a lot of noise," reported the Decatur Daily (Decatur, Alabama). Police arrived at Newman's house five minutes after the 911 call came in, but Newman was already dead, and the killer was gone.

The killer had not gotten cleanly away, however. He was bleeding heavily from a serious wound. Police believe that Newman, who loved guns and kept two ready for use in the house, shot his attacker. Later that night, police received information that a wounded man, Andrew Lackey, was at a hospital receiving treatment for a gunshot wound to the chest. They searched Lackey's rental car and discovered a bloody knife, in conjunction with two guns and other property that were believed stolen from Newman's house.

When Lackey was well enough to leave the hospital, he was charged with capital murder. If he is found guilty, he could get life without parole or the death sentence. Investigators do not know if Lackey knew Newman, but Lackey was close friends with Newman's son and grandson, who could have informed him that Newman was well-off.
