HYDROKINETIC DESIGNS FILES CIVIL SUIT AGAINST RESOURCES CONSERVATION TO HALT SALE OF TWIN HEAD SHOWER SYSTEM

CORAL GABLES, Fla., April 27 /PRNewswire/ -- Hydrokinetic Designs Inc. (HDI), a Coral Gables, FL based manufacturer of a unique, patented, all-brass deluxe twin-head shower system, has filed a civil suit against Resources Conservation Company, Inc. d/b/a Resources Conservation, Inc. (RCI) of Greenwich, CT for a temporary and permanent injunction against further sales and marketing of a product HDI asserts is an exact duplication of the HDI twin head shower system. Michael Wales, President of RCI, is also named as a party in the lawsuit. HDI formerly purchased shower heads from RCI for its dual-headed shower system, marketed as "Shower for Two" and "Shower Sensations(TM)." RCI is currently marketing its shower system under the "Shower for Two" name. RCI is a major manufacturer of shower heads and accessories, with primary concentration in the home center market.

Besides home centers, HDI markets Shower Sensations nationwide to leading department stores, catalog showrooms, mail order houses, hardware chains, home centers, sporting goods outlets, home and bath accessory stores, builders and remodelers, specialty stores and other various retail outlets. HDI has also begun exporting its shower fixtures overseas.

The suit was filed today in Federal Court in the State of Florida by David Friedland of Lott and Friedland PA of Coral Gables, FL. HDI also has retained Terry B. Richardson, Jr. of Ness, Motley, Loadholt, Richardson and Poole PA of Barnwell, S.C. and offices throughout the Eastern seaboard. Patent attorney for HDI is Dr. John D. Mendlein of Cooley, Godward, Castro, Heddleson and Tatum PA of Palo Alto, CA.

In filing the suit, HDI is seeking a temporary and permanent injunction against RCI for infringement of both design and utility patents; unfair competition based upon RCI's product design and packaging; breach of contract; and tortious interference with prospective business relationships. HDI is also seeking monetary and punitive damages.

According to David Black, President of HDI, the "knock-off" RCI product is currently being distributed by at least one major home center and several other outlets in the United States. Through the lawsuit, HDI will seek an order forcing RCI to recall its inventory from these outlets.

Distinctive in design and unique in function, Shower Sensations features twin adjustable shower heads that provide water from multiple angles and allows users to personalize their showering experience to the precise angle and height for optimum warmth and comfort. A multi- directional, two foot extendible arm also adjusts vertically for height and horizontally for positioning the water flow. The shower system is available in brass or chrome.
