The appeals court in Ventura dismissed the developer's suit last week, challenging the validity of a Moorpark referendum that rejected the project's development agreement. ``We're planning to petition for a rehearing on the grounds that the opinion (of the court) misunderstood one issue and didn't address one (other),'' said Wendy Lascher, the attorney for Costa Mesa-based Messenger Investment Co. ``We were very disappointed with the dismissal of the appeal.'' Last week's dismissal follows last year's lower court denial of Messenger's request to remove the measure by the Committee to Qualify Hidden Creek Referendum from the Jan. 12 ballot. That measure, led by local environmental activists Clint Harper and Roseann Mikos, was approved overwhelmingly by the voters along with the Save Open-space and Agricultural Resources measure that was on the same ballot. The case over the development agreement is one of three about the Hidden Creek project, a planned development on 4,300 acres north of Campus Park.
