Sometimes the tours got canceled because of seasonal circumstances or adverse weather. In those circumstances, the guides, who earned $26 per tour, still had to report to work but did not get paid.

"They're just basically sitting around under an employer's control and getting paid zero compensation," he said. "If they're there for eight hours a day and get one tour, they could be making less than minimum wage."

The tour guides also sued for missed meal and rest breaks, since they cannot take breaks while they are on call, Kingsley said.

A call to Starline was not returned.

In the past year, Starline has paid $6,500 in penalties to the State of California for failing to pay adequate wages to its employees. During that time, the state's Department of Industrial Relations' Division of Labor Standards Enforcement has brought five cases on behalf of five separate employees alleging a total of $11,809 in unpaid wages against the company. One claim was dropped, but the company faces $4,900 in two remaining claims.
